1          Terms of website use

Use of our site includes accessing, browsing, or registering to use our site.

1.2       Please read these terms of use carefully before you start to use our site, as these will apply to your use of our site. We recommend that you print a copy of these for future reference.

1.3       By accessing or using our site, you agree to be legally bound by these terms of website use as they may be modified and posted from time to time and confirm that you agree to comply with them.

1.4       You are also responsible for ensuring that all persons who access our site through your internet connection are aware of these terms of website use and other applicable terms and conditions, and that they comply with them.

1.5       If you do not agree to these terms of use, you must not use our site.

1.6       For security reasons and to ensure that you have the best possible experience of our site, we strongly recommend that you use the latest version of your internet browser to access our site.

2          Other applicable terms

2.1       These terms of use refer to the following additional terms, which also apply to your use of our site:

  • Our Privacy Policy, which sets out the terms on which we process any personal data we collect from you, or that you provide to us. By using our site, you consent to such processing and you warrant that all data provided by you is accurate. This also includes our Cookie Policy, which sets out information about the cookies on our site.

2.2       If you purchase goods from our site, our Terms and Conditions of Supply will apply to the sales. Our Terms and Conditions of Supply are available on request, by emailing finance@lymphoma-action.org.uk.

3          Information about us

3.1       www.lymphoma-action.org.uk is a site operated by Lymphoma Action (“We”). We are registered in England and Wales under company number 351875, as a registered charity in England and Wales under charity number 1068395 and as a charity registered in Scotland under charity number SC045850, and have our registered office at Unit 3, Bell Business Park, Smeaton Close, Aylesbury, Bucks HP19 8JR.

3.2       We are regulated by the Charity Commission in England and Wales and the Office of the Scottish Charity Regulator in Scotland.

3.3       We are a company limited by guarantee.

4          Disclaimer about the content on our site

4.1       The content on our site is provided for general information only. It is not intended to amount to advice on which you should rely. You must obtain professional, medical or specialist advice before taking, or refraining from, any action on the basis of the content on our site.

4.2       We may update our site from time to time, and may change the content at any time.

4.3       Although we make reasonable efforts to update the information on our site, we make no representations, warranties or guarantees, whether express or implied, that the content on our site is accurate, complete or up-to-date.

4.4       Our website is intended for a UK-based audience and only in relation to their activities within the UK, and we have used our best endeavours to ensure that our site complies with UK law. However, we make no representations that the materials on our site are appropriate or available for lawful use in locations outside the UK.

5          Accessing our site

5.1       Our site is made available free of charge.

5.2       We do not guarantee that our site, or any content on it, will always be available or be uninterrupted. Access to our site is permitted on a temporary basis. We may suspend, withdraw, discontinue or change all or any part of our site without notice. We will not be liable to you if for any reason our site is unavailable at any time or for any period.

6          Your account and password

6.1       If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party.

6.2       We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these terms of use.

6.3       If you know or suspect that anyone other than you knows your user identification code or password, you must promptly notify us at enquiries@lymphoma-action.org.uk.

7          Acceptable Use Policy

7.1       Our site may only be accessed and used by a private individual or by a business to seek a product or service for themselves. Access to and use of our site otherwise than for your own personal, non-commercial purposes is strictly prohibited and may amount to a criminal offence under the Computer Misuse Act 1990.

7.2       You may only use our site for your own private lawful purposes.  You may not use our site in any manner which:

  • breaches any applicable local, national or international law or regulation;
  • is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect;
  • we consider, in our absolute discretion, is abusive, damaging, defamatory, discriminatory, embarrassing, harmful, harassing, inappropriate, indecent, intimidating, libellous, obscene, objectionable, offensive,  threatening or unethical;
  • to amend, confirm, produce, reproduce, update or verify any data, databases or records;
  • to generate any information which is used by any person to compete with Lymphoma Action;
  • to tamper with, modify, reverse engineer or amend any part of our site;
  • we consider, in our absolute discretion, interferes with, disrupts or imposes an unreasonable or disproportionate burden on our technical or administrative systems;
  • uses any automated or semi-automated algorithm, bot, process, robot, software (including data mining or trawling software), spider, web crawler or other screen scraping algorithm, process, program, software or system;
  • to send, or procure or assist in the sending of any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam); and
  • to send, transmit or upload any data, or material which contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.

7.3       You also agree:

  • not to copy, duplicate, or re-sell any information, data or any part of our site in contravention of the provisions of these terms of website use;
  • not to access without authority, interfere with, damage or disrupt:
    • any part of our site;
    • any equipment, network or server on which our site is stored; or
    • any software used in the provision of our site.

7.4       We may from time to time provide interactive services on our site, including, without limitation:

  • Chat rooms.
  • Bulletin boards.
  • Discussion forums.
  • Online chat services.
  • (interactive services).

7.5       Where we do provide any interactive service, we will provide clear information to you about the kind of service offered, if it is moderated and what form of moderation is used (including whether it is human or technical).

7.6       We will do our best to assess any possible risks for users (and in particular, for children and vulnerable adults) from third parties where they use any interactive service provided on our site, and we will decide in each case whether it is appropriate to use moderation of the relevant service (including what kind of moderation to use) in the light of those risks. However, we are under no obligation to oversee, monitor or moderate any interactive service we provide on our site, and we expressly exclude our liability for any loss or damage arising from the use of any interactive service by a user in contravention of our content standards, whether the service is moderated or not.

7.7       We will determine, in our discretion, whether there has been a breach of this acceptable use policy through your use of our site.  When a breach of this policy has occurred, we may take such action as we deem appropriate. 

8          Uploading content to our site

8.1       Whenever you make use of a feature that allows you to upload content to our site, or to make contact with other users of our site, you must comply with the content standards set out in our Acceptable Use Policy above.

8.2       You warrant that any such contribution does comply with those standards, and you will be liable to us and indemnify us for any breach of that warranty. If you are a consumer user, this means you will be responsible for any loss or damage we suffer as a result of your breach of warranty.

8.3       Any content you upload to our site will be considered non-confidential and non-proprietary. You retain all of your ownership rights in your content, but you are required to grant us (and other users of the site) a limited licence to use, store and copy that content and to distribute and make it available to third parties.

8.4       We also have the right to disclose your identity to any third party who is claiming that any content posted or uploaded by you to our site constitutes a violation of their intellectual property rights, or of their right to privacy.

8.5       We will not be responsible, or liable to any third party, for the content or accuracy of any content posted by you or any other user of our site.

8.6       We have the right to remove any posting you make on our site if, in our opinion, your post does not comply with the content standards set out in our Acceptable Use Policy above.

8.7       The views expressed by other users on our site do not represent our views or values.

8.8       You are solely responsible for securing and backing up your content.

9          Links and Framing

9.1       External links on our site: we are not responsible for the content or reliability of linked websites and any listing by us should not be taken as endorsement of any kind. We have no control over the availability or content of linked pages. Lymphoma Action makes no representations whatsoever about any other websites which you may access through our site or which may link to our site. When you access any other website you understand that it is independent from Lymphoma Action and that we have no control over the content or availability of that website.

9.2       In addition, a link to any other website does not mean that Lymphoma Action endorses or accepts any responsibility for the content, or the use of, such a website or the products or services available thereon and shall not be liable for any loss or damage caused or alleged to be caused by or in connection with use of or reliance on any content, goods or services available on or through any other website or resource. Any concerns regarding any external link should be directed to its respective website administrator or web master.

9.3       Linking to and/or framing from our site: you must ask permission to link directly to or frame pages hosted on our site. Please contact Lymphoma Action at publications@lymphoma-action.org.uk, explaining how and why you wish to use such link and/or frame. Please include your name, organisation, telephone number and email address. You must not establish a link to or frame from our site without our permission, and doing so shall be deemed a breach of these terms of website use.

9.4       We reserve the right to withdraw linking and/or framing permission without notice.

10       Intellectual property rights

10.1     The contents of our site are protected by international copyright laws and other intellectual property rights. Lymphoma Action (including any of its content suppliers) is the owner or the licensee of all intellectual property rights in this site, and in the material published on it.  Those works are protected by copyright laws and treaties around the world. All such rights are reserved. The Lymphoma Action logo and periwinkle is a UK registered trade mark (number UK2439521) of Lymphoma Action.

10.2     You may print off up to five copies, and may download extracts, of any page(s) from our site for your personal private, non-commercial use and you may draw the attention of others within your organisation to content posted on our site.

10.3     If you are individual employed by an NHS body in the United Kingdom you may print off unlimited copies of our web pages for distribution to patients who are in your care.

10.4     You may not otherwise copy, modify, post, reproduce, republish, upload, use, transmit or translate, by any means or in any manner, any material or information on or downloaded from our site including but not limited to text, graphics, audio, video, broadcasts, podcasts, messages, code and/or software without first obtaining our prior written consent.

10.5     You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

10.6     Our status (and that of any identified contributors) as the authors of content on our site must always be acknowledged.

10.7     You must not use any part of the content on our site on any other website or for commercial purposes without obtaining a licence to do so from us or our licensors.

10.8     You must not copy, store in a retrieval system, or transmit in any form or by any means to any third party any part of our website without obtaining an licence to do so from us or our licensors.

10.9     If you print off, copy or download any part of our site or commit any unauthorised acts in breach of these terms of use, your right to use our site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made. We may also make a civil claim against you for damages and/or a criminal prosecution may result. Our actions in light of any breach of these website terms of use are not limited and we may take any other action we reasonably deem appropriate.

11       Limitation of our liability

11.1     Nothing in these terms of use excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

11.2     To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to our site or any content on it, whether express or implied.

11.3     We will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

  • use of, or inability to use, our site;
  • use of or reliance on any content displayed on our site;
  • loss of profits, sales, business, or revenue;
  • business interruption;
  • loss of anticipated savings;
  • loss of business opportunity, goodwill or reputation; or
  • any indirect or consequential loss or damage.

12       General

12.1     We may alter these terms of use, from time to time, and post the new version on our site, following which all use of our site will be governed by such version. Please therefore check this page from time to time to take notice of any changes we made, as they are binding on you.

12.2     If any provision or term of these terms of use is declared invalid or unenforceable by the judgment or decree, by consent or otherwise of a court of competent jurisdiction:

  • such invalidity or unenforceability shall not affect the validity and enforceability of the rest of these terms of use which shall survive in full force and effect;
  • such provision shall be deemed deleted and severed from these terms of use;
  • such deleted provision shall be replaced by such modified provision as shall have the closest effect to the deleted provision but shall at the same time be both valid and enforceable.

12.3     These terms of use and your use of our site are governed by English law and you agree to submit to the exclusive jurisdiction of the English courts in the event of any dispute or claim relating to our site.
