Spring Prize Draw 2019 policies

Lymphoma Action is committed to ensuring that any prize draw activity it conducts is operated in a secure, fair and socially responsible way.

Terms and Conditions of 2019 Spring Prize Draw 

  1. Participation in the Lymphoma Action Spring Prize Draw costs £1 per ticket.
  2. Only those aged 16 years and over are eligible to enter.
  3. All profits from the draw will be donated to Lymphoma Action registered charity number 1068395 (England & Wales) SC045850 (Scotland).
  4. Payment may be made by cheque or credit/debit card. 
  5. No responsibility is taken for tickets and payment lost, delayed, or damaged in the post and proof of posting will not be accepted as proof of receipt.
  6. Any ticket entries received after the closing date of 12pm on Friday 10 May 2019 will miss entry into the draw and will be treated as a general donation to Lymphoma Action.
  7. The Spring Prize Draw will take place on Saturday 11 May 2019 at the Lymphoma Action National Conference in London. Tickets will be manually drawn, randomly in order of highest to lowest prize. Prizes are as follows: 1st Prize - £1,000 2nd Prize - £250, 2 x £100 Prizes and 4 x Runner-up Prizes of £50 each.
  8. The prizes are non-transferable.
  9. All prizes will be paid by cheque or BAC’s transfer depending on the winner preference.
  10. The result of the draw is final.
  11.  Winners will be notified by post within 7 days of the draw date. The winner of first prize will be notified via telephone if a telephone number has been provided. All winners will also be notified in writing.
  12. A complete list of winning numbers along with first names will be published on our website www.lymphoma-action.org.uk.
  13. Where Lymphoma Action is unable to contact a prize-winner and a prize remains unclaimed for six months following the first attempt to notify the prize-winner, Lymphoma Action may apply the prize, as it sees fit, including re-offering the prize in future draws. 
  14. The responsible person for all Charity Prize Draws is Karen Rabjohn, 3 Cromwell Court, New Street, Aylesbury HP20 2PB.
  15. A minimum of 50% of all proceeds, after expenditure, from the Lymphoma Action Prize Draw go to the charity Lymphoma Action, registered office address: 3 Cromwell Court, New Street, Aylesbury HP20 2PB. Lymphoma Action is a registered charity in England and Wales (1088395) and in Scotland (SC045850). A company limited by guarantee registered in England and Wales (number 03518755).

Lymphoma Action’s Prize Draw policy 

Lymphoma Action is committed to ensuring that any prize draw activity it conducts is operated in a secure, fair, and socially responsible way.

Lymphoma Action endorses responsible gambling and this guidance has been created to ensure that our prize draw activity is in line with the regulatory framework set out by the Gambling Act 2005 by:

  • Ensuring that gambling is conducted in a fair and open way.
  • Ensuring that participants have access to the terms and conditions of the prize draw activity, and that the terms and conditions are fair and transparent.
  • Ensuring that all promotional materials for the prize draw are clear and not misleading, and all advertising for all and any prize draw activity complies with the advertising code of practice applicable to the form and media the advert is in.
  • Protecting children, problem gamblers and other vulnerable people from being harmed or exploited by gambling.
  • Preventing gambling from being a source of crime and disorder, being associated with crime and disorder, or being used to support crime.

Prize Draw processing procedures

a) Lymphoma Action conducts its prize draw by means of an external printer to print and distribute an initial allocation of tickets. Otherwise, all selling, promotion and response handing is conducted by trained Lymphoma Action staff and volunteers.

b) A record of all printed tickets sold and unsold is kept by Lymphoma Action. A record of all requests for tickets made via the Lymphoma Action website or taken over the telephone is also retained by Lymphoma Action. Lymphoma Action retains contact details and any other information connected with monies sent in for tickets/ entries received. These records are kept for a minimum of three years in order to comply with Gambling Commission requirements.

c) All draws are conducted by Lymphoma Action staff, in plain sight of two further members of Lymphoma Action staff.

d) All entries and monies received for the Prize Draw are processed by Lymphoma Action. Monies are paid directly into Lymphoma Action’s own bank account.

Policy and procedure on fair and open draws

a) The terms and conditions of all and any prize draws are fair.

b) Participants have access to the terms and conditions (including information on prizes) of the Prize Draw prior to purchasing a chance to win.

c) Any promotional materials for the Prize Draw are clear and not misleading, and all advertising complies with the advertising code of practice applicable to the form and media the advert is in. The principles in these codes should also be applied to all forms and media not explicitly covered by the advertising codes as if they were.

d) Entry is open to all residents of the UK (including Lymphoma Action volunteers) but excludes: Lymphoma Action trustees or directors; or Lymphoma Action employees or third parties each directly involved in the administration or management of the Lymphoma Action Prize Draw, or with the ability to influence the Prize Draw results. Entry costs £1 per ticket, payable in advance, by one of the purchase methods permitted.

e) Volunteers of Lymphoma Action or any third party may only participate in the Prize Draw if they are not involved in the organisation, management or running of the Prize Draw.

f) Persons under the age of 16 years may not sell or buy Lymphoma Action Prize Draw tickets or online entries. Any person who appears to be under the age of 16 years (or any other age limit stated in the terms and conditions of a specific prize draw) will be asked to produce proof of identity and age before they may purchase a Prize Draw ticket. Prizes may not be given to any person under the age of 16 years or any other age limit stated in the terms and conditions of a specific lottery.

g) A maximum of 100 tickets may be purchased by any individual. Lymphoma Action reserves the right to refuse to sell large numbers of tickets, should the motivation for purchase be questionable or there be suspicion or evidence of gambling addiction.

h) In the event that late entries are received after the closing date, Lymphoma Action will contact the player to confirm that they have not been entered into the draw, and to ask whether they would like a refund or be willing to donate the monies received as a cash donation to Lymphoma Action. Lymphoma Action or its third party Prize Draw administrators will not be held responsible for any lost, late or incorrectly formatted entries.

i) Winning tickets will be drawn at random, from all those received before the closing date. The Prize Draw will be monitored by 2 independent witnesses. Tickets and numbers will be photographed and displayed at www.lymphoma-action.org.uk after the draw date. Any tickets which are deemed illegible or defaced may be excluded from the draw at the discretion of the Promoter.

j) A list of winning ticket numbers and corresponding prizes will be published on the Lymphoma Action website after the draw. This information will also be available on request by emailing information@lymphoma-action.org.uk or by sending a stamped addressed envelope to Lymphoma Action, 3 Cromwell Court, Aylesbury HP20 2PB 

k) Prize winners of the Prize Draw will be notified within 14 days in writing. If a telephone number is available, Lymphoma Action may also notify a winner by phone, followed up by written confirmation. Winners do not have to make a claim and all prizes will be paid automatically.

l) All participants in the draw are responsible for providing the charity with up to date contact details. The Charity will not be liable for any loss incurred by the participant caused by the failure of the entrant to inform the charity of any changes or errors to their details.

m) Cash prizes will be paid by cheque in British sterling and may be sent by recorded delivery.

n) Any uncashed or unclaimed prizes will be deemed to be a donation to Lymphoma Action after a period of six months.

o) All participants, and therefore winners, must be resident in the UK. Lymphoma Action reserves the right to charge postage to deliver non-cash prizes outside the UK mainland.

p) Non-cash prizes may need to be collected in person, couriered to the winner or arranged directly by the winner with the prize donor in the case of an event or experience. It is the responsibility of the prize winner to ensure that event or experience prizes are arranged and taken by the specified date, or the prize will be deemed to be forfeited.

q) Rules of the Lymphoma Action Prize Draw (Terms and Conditions) are published on Lymphoma Action’s website, on entry forms/tickets, available at the point of sale and the reverse of raffle tickets.

r) Printed versions of rules are available on request

s) Lymphoma Action has a complaints procedure in place for any lottery or prize draw activity, which is described below.

t) A record is kept of online and ticketed sales, and of tickets distributed and not returned.

u) The Charity reserves the right to amend the terms and conditions, however, in the unlikely event that the terms and conditions of the Prize Draw changes, or the prizes differ, Lymphoma Action will notify all players individually to notify them of the changes. Any changes will also be made available upon request from Lymphoma Action’s Supporter Relations team on 01296 619400.

Data protection

Lymphoma Action will comply with the Data Protection Act 1998 to protect your personal data for the purposes of administering your participation in the Lymphoma Action Prize Draw and communicating with you about the Charity Prize Draw. The Promoter will not share your data with third parties for marketing purposes. Unless otherwise indicated by you, the Promoter may occasionally send you information to keep you up to date with the work that your contributions help fund and other ways in which you can support the Promoter. If required by the Gambling Commission, Lymphoma Action comply with any requests for access to data, in accordance with the law.

Player’s queries, complaints and disputes procedure

A 'complaint' means a complaint about any aspect of the conduct of the licensed activities, and a 'dispute' is any complaint which:

a) is not resolved at the first stage of the complaints procedure; and

b) relates to the outcome of the complainant's gambling transaction.

Staff must ensure that:

  • customers are told the name and status of the person to contact about their complaint
  • customers are given a copy of the complaints procedure on request or on making a complaint
  • all complaints are handled in accordance with the procedure.

Complaints procedure

a) Trained Lymphoma Action staff will receive and deal with the initial complaint.

b) Complaints should, if possible, be investigated and resolved within 5 working days. If an investigation is likely to take longer the complainant will be notified with a proposed timescale, aiming to resolve the complaint within a maximum of 25 working days.

c) A log sheet is completed at the time of the call/ on receipt of the written complaint. The complainants contact information, details of the telephone adviser who took the call or member of staff who investigated the written complaint, the nature of the complaint and how the complaint was investigated and resolved are recorded on the log sheet.

d) If the complainant is unhappy with the resolution of the complaint they should contact Lymphoma Action’s Director of Fundraising who will reconsider the decision and who will contact the complainant within 10 working days.

e) Lymphoma Action is an independent member of the The ADR Group, an independent arbiter who can resolve disputes.

The ADR Group will consider your complaint in light of legalities, policies and procedures and draw final conclusions. In writing, THE ADR Group will then inform the complainant and Lymphoma Action of their decision.

Lymphoma Action is covered by: 2015 No. 542 Consumer Protection, the Alternative Dispute Resolution for Consumer Disputes (Competent Authorities and Information) Regulations 2015

In accordance with Part 4 of 2015 No. 542 Consumer Protection, the Alternative Dispute Resolution for Consumer Disputes (Competent Authorities and Information) Regulations 2015 we inform you that ADR Group is our ADR Entity. At such time as we have exhausted our internal complaints handling procedure when considering a complaint from a customer and we have been unable to settle that complaint ADR Group will be competent to deal with that complaint should the customer wish to use alternative dispute resolution and we will be obliged, or prepared, to submit to an alternative dispute resolution procedure operated by ADR Group 

g) A copy of each decision on, or a note of the outcome of, each dispute referred to The ADR Group will be provided to the Gambling Commission quarterly by Lymphoma Action.

Training policy

Training covering Lymphoma Action’s Prize Draw policies and guidelines is available for all employees.

All employees who work on Lymphoma Action’s Prize Draw must read, understand and act in accordance with the Lymphoma Action Prize Draw Policy, procedures, terms and conditions.

Lymphoma Action will also ensure that any employees who work on the Charity Prize Draw are up to date and compliant with any revisions to policies or working practices as issued by The Gambling Commission due to changes in the Licence Conditions and Codes of Practice (LCCP) and/or the gambling industry.  

Information policy

Lymphoma Action will work with the Gambling Commission in an open and co-operative way and will inform the Commission as soon as reasonably practicable of any matters that the Commission would reasonably need to be aware of in exercising its regulatory functions. These are matters that will have a material impact on Lymphoma Action’s business or on Lymphoma Action’s ability to conduct its business. Such matters would include any major breach in information security which must by law also be reported to the Information Commissioner's Office.

Responsible gambling policy

a) The following procedures have been put in place by Lymphoma Action to encourage people to gamble responsibly and to seek help should gambling develop into a problem. Training is provided so that staff understand their responsibilities, and are aware of advice on socially responsible gambling and of where to get confidential advice should their gambling become hard to control.

b) GamCare is a UK based Charity that offers help and advice on gambling. Their helpline number is 0808 8020 133 and website is www.gamcare.org.uk. These details are included on all Charity Prize Draw tickets.

c) Lymphoma Action must interact with a supporter where a concern arises that their behaviour may indicate problem gambling. If applicable Lymphoma Action will provide individuals with information on gambling support organisations. The appropriate level of management to initiate this type of customer interaction is the named Promoter of the lottery, or another Annex A operating licence holder.

d) Players, or carers of a vulnerable person, can request self-exclusion from our database for further Prize Draw mailings. The exclusion will be valid indefinitely until such a time as Lymphoma Action receives written confirmation from the player themselves or their carer, confirming that they agree to accept lottery or prize draw marketing material.

e) Should a prize winner be found to be under the age of 16 years old, we will refund their money and withhold the prize. Additionally the charity reserves the right to carry out checks to verify the age of the participant.

f) Lymphoma Action shall take steps to remove the name and details of a self-excluded individual from any marketing databases relating to a prize draw associated with the Charity (or otherwise flag that person as an individual to whom prize draw marketing material must not be sent), within two days of receiving the completed self-exclusion notification. Staff will be trained so that they are able to enforce these systems.

h) Where a customer chooses not to renew the self-exclusion, and makes a positive request to begin gambling again, the customer is given one day to cool off before being allowed access to gambling facilities. The contact must be made in writing.

Gambling responsibly and problem gamblers information

a) Lymphoma Action is committed to contributing towards the identification and treatment of problem gamblers.

b) Lymphoma Action is committed to contributing to public education on the risks of gambling and how to gamble safely. The majority of people do gamble responsibly.

c) The following information is in place to help you to gamble responsibly:

  • You're buying fun, not investing your money.
  • Set strict limits on how much time and money you're willing to spend.
  • Quit while you're ahead.
  • Only gamble with money you can afford to lose.
  • Don't spend more money in the hope of winning back what you have lost.
  • Keep up other interests and hobbies - don't let gambling take over your life.
  • Don't gamble in order to escape from stress or boredom.
  • Gambling in moderation is okay.

d) However, for some gambling can become a problem. If you’re concerned about the amount you are gambling, (or you are concerned for a friend or relative) then the following questions may help give you some guidance:

  • Have you been criticised for your gambling?
  • Have you lied to cover up the financial amount or the time you have spent gambling?
  • Do arguments, stressful situations or disappointments make you want to gamble?
  • Do you gamble alone for long periods?
  • Do you stay away from work or college to gamble?
  • Do you gamble to escape from a boring or unhappy life?
  • Are you reluctant to spend 'gambling money' on anything else?
  • Have you lost interest in your family, friends or pastimes due to gambling?
  • If you lose, do you feel you must try to win back your losses as soon as possible?
  • When you run out of money while gambling, do you feel lost and in despair, and feel the need to gamble again as soon as possible?
  • Do you gamble until your last penny is gone?
  • Have you lied, stolen or borrowed to get money to gamble or to pay gambling debts?
  • Does your gambling ever make you feel depressed or even suicidal?

e) If you feel you are answering 'yes' to the majority of the questions above, then it is likely a gambling problem exists. Sometimes just telling someone about your concerns can be a relief and the first step toward dealing with your problem.
